Read these terms and conditions carefully. By using the site you agree to be bound by the terms and conditions contained and specified herein. The terms and conditions may also be varied from time to time and by continuing to use this site after such variations you agree to be bound by such variations. Should you not agree to be bound by the terms and conditions of this site then you do not have any permission to use this website, nor purchase tickets to attend the 2011 Playboy Mansion Party

Once in a Lifetime Promotions Pty Ltd ACN is 141 909 739 is the operator of this website (in some provisions referred to us “we”).

1. Once in a Lifetime Promotions Pty Ltd ACN is 141 909 739 is authorised to promote the events, material and trademarks, copyright, patents and other intellectual property and concepts contained herein. Such property however remains the property of the respective owners.

2. You may use this site for your personal use only and apart from where reasonably required for your personal use in conducting a permissible transaction on the site may not otherwise use or otherwise copy, reproduce, publish, store alter or transmit any information contained on this site (except where permissible by law) without the prior written approval and consent of Once in a Lifetime Promotions Pty Ltd.

3. Tickets purchased online through this site are purchased through the  use of Paypal and the terms and conditions of use of the paypal service as may be specified by it from time to time form part of the terms and conditions of use of this site and any agreement with Once in a Lifetime Promotions Pty Ltd.

4. Once in a Lifetime Promotions Pty Ltd is an authorised distributor of tickets to the “2011 Ooh La La Party at the Playboy Mansion & Party Weekend” and other events but at all times acts as an agent of the original seller of the tickets for such events. Any and all claims are against the seller Partying for a purpose and to the fullest extent permissible by law Once in a Lifetime Promotions Pty Ltd has no liability to you.

5. As a condition of sale (which includes any resale or assignment where permitted) of tickets to any event or promotion and also as a condition of attendance at any event or promotion:-

1. There shall be no refund or exchange on any ticket except as required by law or as specified by the seller;
2. If a refund is made by the seller then Once in a Lifetime Promotions Pty Ltd reserves the right to the fullest extent permissible at law to retain an amount reasonably incurred by it in requesting, negotiating and recovering any refund from the seller on your behalf;
3. We reserve a right to charge a fee for replacement tickets, which replacement tickets shall only be given if agreed by the seller;
4. The seller of all tickets to the Playboy Mansion Party (“the party”) is Partying for a Purpose Inc an incorporated body registered in San Diego, USA. You acknowledge that it is the strict policy of Partying for a Purpose Inc that it will not refund ticket prices where the party is cancelled or re- scheduled and you acknowledge that such cancellations or re- scheduling are beyond the control of either the seller or Once in a Lifetime Promotions Pty Ltd;
5. Additionally you  acknowledge that where an event is cancelled or re- scheduled neither the seller nor Once in a Lifetime Promotions Pty Ltd are liable for any loss suffered by you in any way including but not limited to airfares, accommodation and similar. 

6. The right is retained by both the seller and the venue operator of any event to reserve entry, and enforce its or their own terms and conditions of entry. You acknowledge that Once in a Lifetime Promotions Pty Ltd is in no way responsible for any loss suffered or claimed to be suffered by you as a result of any imposition of the terms and conditions of the seller’s or venue operator’s terms of entry.

7. You acknowledge that it is a condition of entering into licensed premises in the United States of America where the party is to be held that entrants must be over the age of twenty- one (21) years. You acknowledge that you or any other person on whose behalf tickets to the party are purchased will be twenty- one (21) years of age as at the date of the party as indicated on this site.

8. Tickets may not without the prior written consent of Once in a Lifetime Promotions Pty Ltd and a seller be resold or otherwise offered for resale at a premium or used for advertising, promotion or other commercial purpose either by the original purchaser or by any subsequent bearer whether obtained legally or illegally. If any ticket is sold or otherwise used in breach of this condition then such ticket may be cancelled without any refund and no liability is accepted for any loss howsoever arising from such cancellation.

9. Whilst all care is taken to verify the same no warranty is provided by Once in a Lifetime Promotions Pty Ltd that the information contained on this website relating to any event or promotion or any other information is correct or accurate.

10. The existence of any listings or advertising on this website does not constitute a guarantee or warranty or endorsement of the quality of the products, services or events so listed or advertised.

11. Once in a Lifetime Promotions Pty Ltd may collect personal information from you as users of its website or otherwise as a purchaser of goods or services. Such information is typically collected so as to inform you of any event cancellations or variations. Where your personal information is collected Once in a Lifetime Promotions Pty Ltd its servants and agents recognise the requirement to keep such information confidential and will at all times comply with the requirements imposed by the Privacy Act 1988 (Cth).

12. To the fullest extent permitted by law Once in a Lifetime Promotions Pty Ltd is not liable for any direct,  incidental, consequential, or indirect damage or loss sustained by you or alleged to be sustained by you as a result of your use of our website or any alleged inability to use our website or through the purchase of any tickets or items from Once in a Lifetime Promotions Pty Ltd howsoever transacted and howsoever arising whether any such claim is based upon an alleged breach of contract, or in tort including due to negligence or by way of any alleged breach of any statute or subordinate legislation regardless of jurisdiction and whether or not any such damage was foreseeable.

13. This agreement is governed by the laws of the State of South Australia and you fully submit to the laws and the Courts of that jurisdiction.

14. You agree that you have not relied upon any other representations made by us with respect to the provision of our services that are not set out in this agreement. To the extent that any part of these terms and conditions are held to be unenforceable at law, then such unenforceable part shall be given the fullest effect legally possible upon it being read down and the remainder of this agreement shall be given full force and effect.

Further terms and conditions for 2011 Poker Series Entrants.
These terms should be read in conjunction with and form part of the general terms and conditions of usage of the site and any services provided by Once in a Lifetime Promotions Pty Ltd ACN is 141 909 739

1. You confirm that you are over the age of eighteen (18) years.

2. You acknowledge that the promoter of the 2011 Poker Series competition and retains all property in any photographs taken of you during the course of the competition and that it may use such photos and any other photo­graphs provided by you on its website subject to any intellectual property rights held by any other party.

3. Except where required to be used for the purpose of the 2011 Poker Series competition your personal information will be treated in accordance with our privacy policy.

4. Once in a Lifetime Promotions Pty Ltd is not liable for any direct, incidental, consequential, or indirect damage or loss sustained by you or alleged to be sustained by you as a result of your use of our website, or the use of your image on our website or your participation in the 2011 Poker Series howsoever arising whether any such claim is based upon an alleged breach of contract, or in tort including due to negligence or by way of any alleged breach of any statute or subordinate legislation regardless of jurisdiction and whether or not any such damage was foreseeable.

5. Your participation in the competition is conditional upon any restrictions imposed by any venue and Once in a Lifetime Promotions Pty Ltd is not liable for any refusal by any venue to enable you to participate or continue to participate in the competition at such venue.

6. Once in a Lifetime Promotions Pty Ltd reserves the right to exclude any entrant from the competition at any stage without reason and shall not be liable in any way for any damage suffered, or alleged to be suffered by you as a result of such exclusion from the competition. In the event that you are so excluded from the competition the liability of Once in a Lifetime Promotions Pty Ltd if any (at our discretion), is limited to the refund of your entrance fee.

7. It is a term of your entry into the competition that you will travel to the United States of America by air with representatives of Once in a Lifetime Promotions Pty Ltd and will attend at the Playboy Mansion in Los Angeles, USA for the 2011 Ooh La La Playboy Mansion Party which is scheduled to occur on the 20th of August, 2011. By entering the competition you also agree to make yourself available to attend that function and to be regarded as a representative of Once in a Lifetime Promotions Pty Ltd.

8. The prize is personal to the winner of the competition and the event that the winner is unable to attend Once in a Lifetime Promotions Pty Ltd the prize will be transferable however the notification period is limited and Once in a Lifetime Promotions Pty Ltd MUST be notified by the 1st of August at 3pm Adelaide time. Failure to do so will result in a forfeit of the Major Prize.

9. No prizes are redeemable by way of cash or exchange for any other prize and the first prize cannot be postponed for attendance at the Mansion Party in subsequent years or for attendance at any alternative events or promotions.

10. Whilst acting as a representative of Once in a Lifetime Promotions Pty Ltd you agree to act in a professional manner at all times and represent Once in a Lifetime Promotions Pty Ltd with the utmost consideration for our reputation and objectives.

11. Notwithstanding that you may be acting as a representative of Once in a Lifetime Promotions Pty Ltd nothing in this agreement or in any other act or representation by Once in a Lifetime Promotions Pty Ltd its employ­ees or agents, you or any other party shall deem you to be an employee of the company and nothing in this agreement is construed as to constitute Once in a Lifetime Promotions Pty Ltd to be your employer and you to be an employee. It is the express intention of the parties that such a relationship is denied.

12. You confirm that you will aged twenty- one (21) years or over as at the date of the Mansion Party and that you will provide satisfactory evidence of your age to Once in a Lifetime Promotions Pty Ltd as at the time of your entry into the 2011 Poker Series otherwise you will be excluded from being eligible to claim the major prize.

13. You acknowledge that you will be asked to confirm your age at the Mansion Party and other events in the United States of America which you may be required or otherwise invited to attend and if you are unable to provide such identification you may be excluded from attendance. In that event you acknowledge that Once in a Lifetime Promotions Pty Ltd has the right to recover the costs of your travel and accommodation to the United States of America.

14. As per the general terms and conditions of this site you acknowledge that in the event that the Mansion Party is cancelled and or the 2011 Once In A Lifetime Poker Series for any reason or if you are otherwise unable to attend, then you have no right of recovery or any claim or cause of action against Once in a Lifetime Promotions Pty Ltd, its employees or agents.
